FAQs
We have a variety of experience and expertise within our Onchan based office that no other Managing Agent can offer.
Sterling Property is the Agent of your Management Company and charges the Company a fee for which it oversees General Maintenance, Financial as well as Secretarial matters.
The Directors of the Management Company are responsible for the appointment of Managing Agents and will have chosen Sterling to fulfil this role.
Sterling’s appointment is subject to a formal Management Agreement which details the services we provide and the costs of these which are paid by the Management Company from the Service Charge.
Sterling has a schedule to visit each property every 3 months or more regularly where appropriate. All Contractors are instructed to advise Sterling if they notice any issues requiring attention.
An out of office hours hour emergency callout number is clearly indicated on notices placed in the Communal areas of the buildings.
The Management Company CANNOT take action to mitigate. However between the hours of 11pm and 7am the Police can take action in accordance with the 2006 Noise Act and should be called. Outside of these hours it is the responsibility of Department of Environmental Health or YOU to take action!
Different apartments blocks will have different rules and lease terms. Please check the lease and management rules as it is often restrictive. If you don’t have a copy of your lease, you can obtain one from your Advocate or the Land Registry.
Before making any physical alterations or reconfiguration you will need to seek permission from the management company, in addition to statutory approval (planning, building regulation, flat registration and fire regulation).
These matters must be reported to the police and your management company should be notified of the reason of the report.
Smoking is allowed in the apartments unless the lease prohibits it. Smoking is strictly prohibited in all communal areas as well. If smoking outside the property, cigarette ends must be disposed of responsibly.
It varies from company to company but typically the Insurance covers accidental damage to the structure of the building (internal communal area and services) but NOT defective materials, workmanship or wear and tear.
The Company Building Insurance Policy DOES NOT cover the contents of your Apartment and you should arrange contents insurance.
If parking spaces are allocated they will form part of the lease and disputes should be directed to Advocates for clarification or opinion with findings notified to the Management Company. The Management Company is NOT responsible for car park management, only its maintenance.
NO – Fire Regulations state that all hallways and stairs must be free of all personal belongings AT ALL TIMES,
The fire alarm system in the buildings are not directly connected to the fire station. If fire alarm goes off, do not turn it off, please ring 999 and evacuate the building. DO NOT assume someone else has called the Fire Brigade.
Under the terms of the lease you are required to pay service charges. Non-payment breaches the lease and can result in its forfeiture and you losing the apartment.
Sadly at present, that facility is not available. Payments can be made by cheque or bank transfer.
The cost of communal/shared utilities, and the maintenance that the Management Company is obliged to pay under the lease, together with any contracted third party services (e.g. cleaning, fire alarm testing, building insurance, accounts administration)
You will have breached your lease agreement which could ultimately lead to you losing the apartment via lease termination through the courts. If you do not pay your service charge other leaseholders are subsidising your contribution to maintain the development.
Your lease clearly stipulates what is included in your service charge. As service charges are often calculated on a square footage basis, it may well be down to the different size of the apartments.
Service charges differ from block to block however the communal services that should be included are clearly set out in the lease: The costs of these services are budgeted for and divided on a proportional basis as specified in the Lease.
The demised premises (Your apartments/responsibility) is clearly stipulated within the lease but typically includes all the interior of the apartment and where appropriate, the balcony.
Sterling’s aim is to respond to these enquiries within 10 working days from the day of the initial receipt of the letter.
The lease clearly indicates your obligations as well as that of the Management Company. Each development and lease differs. This should be clarified with your legal advisor.
The lease clearly states whether this is possible and often if Management Company consent is required. Any sublease / tenancy agreement should mirror the head lease. If you are a first time buyer and have a mortgage through the government scheme, you not permitted to sublet.
